Question: Is a sole proprietor business owner covered under the fdcpa?

I am a sole proprietor business owner. I have an Advanta Credit Card under my business name and my personal name. I used the card to pay for some business purchases and since the economy went south, I used the card to pay for personal needs; mortgage, groceries etc. I failed to pay and now a debt collector is calling me, threatening to sue. I asked them to send me written debt verification under the FDCPA. The debt collector said that a commercial account is not subject to the FDCPA. Since my business is not incorporated and the major part of the debt incurred went to cover personal living expenses am I covered under the FDCPA? I called the FTC and they only told me that a "natural person " is covered but they would not answer specific questions. Please help. |
